Pay Transparency Laws

In New York State, the Pay Transparency Law (signed on December 21, 2022) took effect on September 17, 2023. This law mandates salary transparency in job postings across the state. Key provisions include:

1. Who Is Covered:
  • Employers with four or more employees.
  • Applies to jobs, promotions, or transfer opportunities that will physically be performed in New York State, including remote jobs tied to a New
    York-based office.
2. What Must Be Disclosed:
  • Employers must include the compensation range (minimum and maximum salary or hourly wage) for the position.
  • Employers must also provide a job description if one exists.
  • The range should reflect what the employer honestly believes they are willing to pay at the time of the posting.
3. Record-Keeping:
  • Employers are required to maintain records of job descriptions and compensation history.
4. Penalties for Non-Compliance:
  • The law is enforced by the New York State Department of Labor
    (NYSDOL), and employers who fail to comply may face fines and other penalties.
